Terms & Conditions

This end user agreement (the “Agreement”) should be read by you (the “User” or “you”) in its entirety prior to your use of the Service. The Agreement constitutes a legally binding agreement between you and LuckyClash.

These Terms & Conditions come into force as soon as you complete the registration process, which includes checking the box accepting these Terms & Conditions and successfully creating an account. By using any part of the website following account creation, you agree to these Terms & Conditions applying to your use of the Service.

You must read these Terms & Conditions carefully in their entirety before creating an account. If you do not agree with any provision of these Terms & Conditions, you must not create an account or continue to use the Service.

We are entitled to make amendments to these Terms & Conditions at any time. If we make such amendments, we may take appropriate steps to bring such changes to your attention (for example by email or by placing a notice on the website), but it shall be your sole responsibility to check for any amendments, updates and/or modifications. Your continued use of the Service after any such amendment will be deemed acceptance of and agreement to be bound by such amendments.

In order to play on LuckyClash you must first personally register an account with us (your “Account”). As part of registration you will provide a valid email address and choose a username and password. You must enter all mandatory information requested. It is your sole responsibility to ensure that the information you provide is true, complete and correct. You must choose a username which is not disruptive or offensive.

It is your sole and exclusive responsibility to keep your login details secure. You must not disclose your login details to anyone. We are not liable for any abuse or misuse of your Account by third parties resulting from your disclosure of your login details.

You are allowed only one Account. If you attempt to open more than one Account, all of your accounts may be blocked, suspended or closed and any balance credited may be frozen. If you notice that you have more than one registered Account you must notify us immediately.

You will inform us as soon as you become aware of any errors with respect to your Account or any calculation relating to a game you have played. We reserve the right to declare null and void any plays that are subject to such an error.

LuckyClash will not accept registration from individuals who:

• Are under 18 years old or under the legal age of majority for gambling in their jurisdiction;
• Reside in jurisdictions from which such use is illegal or where gambling is not permitted. LuckyClash cannot verify the legality of the Service in every jurisdiction and it is the User's responsibility to ensure that their use of the Service is lawful;
• Provide misleading information or attempt to impersonate third parties.

You are prohibited from selling, transferring or acquiring accounts to or from other players.

LuckyClash reserves the right, at any time, to request any KYC documentation it deems necessary to determine the identity and location of a User. LuckyClash reserves the right to restrict the Service, a payment or a withdrawal until identity is sufficiently determined, or for any other reason at its sole discretion. By using the Service you acknowledge and consent to the possibility of disclosure of your information as required to comply with legal process or as otherwise permitted by our Privacy Policy.

Prior to your use of the Service and on an ongoing basis you represent, warrant and agree that:

• You are over 18, or such greater legal age of majority as determined by the laws applicable to you;
• You have full capacity to enter into a legally binding agreement with us;
• You are not diagnosed or classified as a compulsive or problem gambler;
• You are accessing LuckyClash from a jurisdiction in which it is legal to do so;
• All information you provide to us is true, complete and correct, and you will immediately notify us of any change;
• You are not currently self-excluded from any gambling site or premises, and you will inform us immediately if you enter into a self-exclusion agreement with any gambling provider;
• Your use of the Service is at your sole option, discretion and risk;
• You participate strictly in your personal, non-professional capacity and for recreational and entertainment purposes only;
• You participate on your own behalf and not on behalf of any other person;
• You are solely responsible for reporting and accounting for any taxes applicable to any winnings you receive from us;
• There is a risk of losing funds when using the Service and LuckyClash has no responsibility to you for any such loss;
• In relation to deposits and withdrawals, you shall only use crypto that is valid and lawfully belongs to you;
• You accept that the value of cryptocurrency can change dramatically depending on market conditions;
• You accept that we reserve the right to detect and prevent the use of prohibited techniques, including fraud detection, automated registration and gameplay, geo-location and IP-masking detection, and transaction and blockchain analysis;
• The telecommunications networks and internet access services required to use the Service are beyond the control of LuckyClash, which shall have no liability for any outages, slowness, capacity constraints or other deficiencies.

LuckyClash disclaims all warranties, express or implied, in connection with the Service, which is provided to you “as is”. Regardless of our efforts, we make no warranty that the Service will be uninterrupted, timely or error-free, or that defects will be corrected.

You may participate in a game only if you have sufficient funds in your Account. You shall use the payment methods available on LuckyClash to deposit funds. LuckyClash will not give you any credit for participation in any game.

Deposits can only be made with your own funds, transferred from crypto wallets under your control or through any other payment method available on luckyclash.io. Deposits are processed and the updated balance is shown in your Account as soon as the payment provider confirms the transaction. LuckyClash is not responsible for delays caused by its payment system or by any third party.

Funds cannot be transferred from your Account to another player’s Account. Some payment methods may include an additional fee; where applicable, the fee will be clearly visible in the cashier. LuckyClash may refuse any deposit at its own discretion.

Crypto withdrawals will be made to the cryptocurrency wallet address you state when making a valid withdrawal request.

If we mistakenly credit your Account with winnings that do not belong to you, whether due to a technical error, human error or otherwise, the amount remains our property and will be deducted from your Account. If you have withdrawn funds that do not belong to you before we become aware of the error, the mistakenly paid amount constitutes a debt owed by you to us. You are obliged to notify us immediately of any incorrect crediting.

LuckyClash reserves the right to carry out additional KYC verification for any withdrawal. All transactions are checked in order to prevent money laundering. If you become aware of any suspicious activity you must report it to us immediately. We may suspend, block or close an Account and withhold funds where required by applicable anti-money-laundering law or by any competent authority.

You acknowledge that funds are consumed instantly when playing and that we do not provide refunds or retrospective cancellation of plays.

LuckyClash may, at its sole discretion, offer bonuses and promotions from time to time. Each bonus or promotion has its own terms, conditions and requirements. By activating a bonus or promotion you confirm that you also agree to the applicable terms.

Once forfeited or de-activated, a bonus will no longer be available to you and cannot be re-activated. LuckyClash reserves the right to remove bonuses from inactive accounts or accounts identified as “bonus abusers”, to cancel any bonus not claimed within its claiming period, and to cancel any bonus at its sole discretion.

Every game outcome on LuckyClash is decided by a server random number generator using a cryptographic commit and reveal scheme. Before a round the server publishes a sealed commitment; afterwards it reveals the seed so you, or any auditor, can recompute every result and confirm nothing was changed. You agree to the game rules described on the website. The decision of LuckyClash’s management concerning any use of the Service or dispute resolution is final.

Personal use. The Service is intended solely for the User’s personal entertainment. Users may not create multiple accounts for the purpose of collusion or abuse of the Service.

AML & sanctions compliance. LuckyClash expressly prohibits the use of the Service for any form of illicit activity, including money laundering, terrorist financing or trade-sanctions violations. The Service is not offered to individuals or entities subject to United States, European Union or other global sanctions or watch lists. By using the Service you represent and warrant that you are not so subject.

Jurisdictions. Persons located in or resident in prohibited jurisdictions are not permitted to use the Service. Any attempt to circumvent these restrictions — including manipulating the information used by LuckyClash to identify your location, or providing false or misleading information about your location or residence — is a breach of this Agreement.

Without prejudice to any other rights, if a User breaches in whole or in part any provision contained herein, LuckyClash reserves the right to take such action as it sees fit, including terminating this Agreement and/or taking legal action against the User.

You agree to fully indemnify, defend and hold harmless LuckyClash and its owner, directors, agents and employees from and against all claims, demands, liabilities, damages, losses, costs and expenses arising as a result of: (i) your breach of this Agreement; (ii) your violation of any law or any third-party rights; and (iii) your use of the Service.

Under no circumstances, including negligence, shall LuckyClash be liable for any special, incidental, direct, indirect or consequential damages whatsoever (including, without limitation, loss of profits, business interruption or loss of information) arising out of the use or misuse of the Service, even if LuckyClash had prior knowledge of the possibility of such damages. Nothing in this Agreement shall exclude or limit LuckyClash’s liability for death or personal injury resulting from its negligence.

LuckyClash and its licensors are the sole holders of all rights in and to the Service and its code, structure and organization, including copyright, trade secrets and other intellectual property rights. You may not copy, distribute, publish, reverse engineer, decompile, disassemble, modify or translate the website, or use the Service in any manner prohibited by applicable law. The name “LuckyClash”, its domain names and all other trade marks, together with all site content, belong to LuckyClash and are protected by copyright and other rights. You obtain no rights in the site content or trade marks by using the Service.

If you wish to make a complaint, please contact our support team at support@luckyclash.io or, for formal complaints, at complaints@luckyclash.io. We will endeavour to resolve the matter promptly. Should any dispute not be resolved to your satisfaction, you may pursue remedies in the governing-law jurisdiction set out below.

LuckyClash reserves the right to update or modify this Agreement, or any part of it, at any time. You will be bound by the amended Agreement upon posting, so we encourage you to check the version in force at any given time.

This Agreement and any matters relating to it shall be governed by, and construed in accordance with, the laws of the jurisdiction in which the Operator is established. If any provision of this Agreement is or becomes illegal, invalid or unenforceable in any jurisdiction, that shall not affect the validity or enforceability of any other provision.

No waiver by LuckyClash of any breach of any provision of this Agreement shall be construed as a waiver of any subsequent breach. Nothing in this Agreement shall create any partnership, agency, trust, fiduciary relationship or joint venture between you and LuckyClash. This Agreement constitutes the entire understanding between you and LuckyClash regarding the Service and supersedes any prior agreement or arrangement.
